These Terms of Service (“Terms”) govern your use of the website design, development, SEO, AEO, and related services (“Services”) provided by AlbertaWeb.Design (operated by Elevate Vision Digital). By engaging our Services, you agree to be bound by these Terms.

Please read these Terms carefully before using our Services. If you do not agree with any part of these Terms, you must not use our Services.

1. Website Packages & Services

AlbertaWeb.Design offers fixed-price website packages as well as custom project proposals. Our services include, but are not limited to:

  • Website design and development
  • Search engine optimization (SEO)
  • Answer engine optimization (AEO)
  • Website maintenance and hosting
  • Content creation and copywriting

The specific scope, deliverables, timeline, and pricing for your project will be outlined in a written agreement, project proposal, or invoice provided to you. In the event of any conflict between these Terms and your specific written agreement, the written agreement shall prevail.

2. Project Scope & Changes

The scope of each project is defined in the written agreement or invoice provided to the client. Any work requested beyond the agreed scope — including additional pages, features, design revisions beyond those included in your package, or content creation — may result in additional charges at our standard rates.

Any changes to the project scope must be agreed upon in writing by both parties before work proceeds. We reserve the right to adjust timelines and pricing accordingly.

3. Client Responsibilities

As a client, you are responsible for providing:

  • Content & Copy: Text, images, logos, branding assets, videos, and any other content you wish to include on your website, delivered in a timely manner.
  • Photos & Media: High-resolution photographs, team headshots, property images, and any other media required for the project. You represent that you have the legal right to use all materials provided.
  • Access & Logins: Access to your domain registrar, hosting account (if applicable), Google Business Profile, social media accounts, and any other platforms required to complete the work.
  • Timely Feedback: Prompt review and approval of deliverables at each stage of the project.

Project timelines are directly dependent on the client's responsiveness. Delays in providing content, feedback, or approvals may result in extended project timelines. We will make reasonable efforts to communicate any delays and adjust schedules accordingly.

4. Project Timelines

Estimated timelines are provided in good faith based on the agreed project scope and typical responsiveness. However, actual timelines depend on:

  • Client response and approval times
  • Timeliness of content, assets, and information provided by the client
  • Technical complexities discovered during development
  • Third-party dependencies (e.g., domain transfers, API integrations)
  • Change requests or scope additions

We will keep you informed of progress and any factors affecting the timeline. Timelines provided are estimates and are not guaranteed completion dates unless explicitly stated in a written agreement.

5. No Guaranteed Google Rankings

While we employ industry-leading SEO and AEO practices to optimize your website for search engines, we cannot and do not guarantee specific search engine rankings, positions, or traffic volumes.

Search engine algorithms are proprietary, constantly changing, and influenced by factors beyond our control, including competitor activity and search engine policy updates. Our services are focused on implementing best practices to maximize your chances of strong organic performance, but results will vary.

No refunds will be provided based on failure to achieve specific search rankings, as this is outside our control.

6. Invoices & Payment Terms

Payment terms are specified in your project proposal or invoice. Standard terms include:

  • Deposit: A 50% deposit is typically required before work begins on new website projects.
  • Final Payment: The remaining balance is due upon completion or prior to website launch, as specified in your agreement.
  • Payment Methods: We accept e-transfer, credit card, and other methods as agreed in writing.
  • Late Payments: Invoices unpaid after 30 days from the due date may incur a late fee of 1.5% per month (or the maximum rate permitted by law). Continued non-payment may result in suspension of services.

All prices are in Canadian Dollars (CAD) unless otherwise stated. Applicable taxes (GST/HST) will be added to invoices as required by law.

7. Intellectual Property & Ownership

Design and Development: Upon full payment of all amounts due for the project, the client receives full ownership of the custom-designed website, including the design files, source code, and content created specifically for the project.

Licensed Materials: Any third-party assets (fonts, images, plugins, libraries) used in the project remain under their respective licenses. We ensure these are properly licensed for your use, and we will provide details of any licensed materials upon request.

Portfolio Rights: We reserve the right to display completed projects in our portfolio, case studies, and marketing materials unless a mutual non-disclosure agreement is in place.

Pre-existing Work: Any code, tools, or frameworks we developed prior to your project and reuse in your website remain our intellectual property. We grant you a perpetual, non-exclusive license to use such pre-existing work as part of your website.

Ownership of your website transfers to you only after all invoices have been paid in full. Until such time, AlbertaWeb.Design retains all rights to the work.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AlbertaWeb.Design (Elevate Vision Digital) and its owners, employees, and contractors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions caused by third-party hosting, domain registrars, or other service providers
  • Damages arising from unauthorized access to your website or data
  • Any claims arising from content, images, or materials provided by the client

Our total liability for any claim arising from or related to our Services shall not exceed the total amount paid by you for the specific service giving rise to the claim.

9. Termination

Either party may terminate a project agreement with written notice. In the event of termination:

  • The client shall pay for all work completed up to the date of termination at the proportionate rate.
  • Any deposit paid is non-refundable, as it covers initial project setup, discovery, and reserved time.
  • Upon payment for completed work, the client receives ownership of deliverables produced up to the termination date.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved in the courts of Calgary, Alberta.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our Services after changes constitutes acceptance of the revised Terms.
